contact statusses

Hi, for a client I am creating a membershipsite with the complete Fluent Stack of plugins.
I have a question regarding contact status. All contacts need to be able to receive communication regarding the membership/community.

However, they can receive optionally the marketing mails.

Problem is, once they unsubscribe from the marketing mails, they don't receive the other communication.

I was looking to the transactional status, but that cuts out everything else, so no option.

Can anyone help me with a solution for this?
